Legal Obligations and Operational Benefits

TM44 inspections are mandatory energy assessments for air-conditioning systems across the UK. Required under the Energy Performance of Buildings Regulations, they apply to any building with a combined cooling capacity of 12kW or more, regardless of building type or sector.

The term TM44 refers to the CIBSE (Chartered Institution of Building Services Engineers) guidance document that outlines the methodology and best practice for carrying out these inspections. Only accredited Level 3 or Level 4 air-conditioning energy assessors are permitted to undertake them.


Regulatory Framework and Enforcement

Compliance is monitored and enforced by local authority Trading Standards, who may request proof of a valid TM44 report at any time. Failure to provide one can result in fixed penalties – typically £300 per system, issued repeatedly until compliance is achieved.


Who Needs a TM44?

Any organisation operating qualifying air-conditioning systems, including:

  • Commercial offices and multi-let premises

  • Retail stores and shopping centres

  • Hospitality, leisure and hotel environments

  • Industrial units, warehouses and manufacturing sites

  • Education, healthcare and public sector buildings

  • Mixed-use or managed properties

Multiple small split systems are aggregated toward the 12kW threshold, meaning many businesses qualify without realising.

A TM44 inspection provides:

  • Performance analysis and energy-efficiency recommendations

  • Identification of maintenance or operational issues

  • Strategies for reducing carbon emissions and running costs

  • Improved reliability and system longevity

Without a valid TM44, organisations face financial penalties, unnecessary energy waste, and potential challenges with tenant management, ESG reporting and audit trails.
